Hotel Sues Company Over Broken Pipe

The owners of a new Seabrook hotel are suing a plumbing company over a broken pipe that allegedly caused more than $3.1 million in water damage that took months to repair.

Omkar Group Seabrook LP, doing business as Springhill Suites Seabrook, filed the complaint against Sun Coast Plumbing Co. Inc. on Dec. 7 in Harris County District Court. Omkar Group says Sun Coast was responsible for a faulty pipe connection that allowed hot water to flood the three-story hotel.

According to the lawsuit, Omkar contracted with Lazbert Inc. to oversee construction of Springhill Suites Seabrook. Lazbert subcontracted with Sun Coast to install plumbing in the property.

Omkar says Sun Coast violated the subcontractor agreement by hiring its own subcontractors to complete some of the work. The sub-subcontractors allegedly wore Sun Coast uniforms and drove the company’s vehicles to hide the fact that they had been hired without permission from Omkar or Lazbert.

The 90-room hotel on Nasa Parkway was set to open in mid-April. Prior to opening, Omkar says a Marriott representative visited Springhill Suites Seabrook to certify the property met the franchisor's standards.

While staying at the hotel, the Marriott employee discovered water dripping into the guest room. Omkar says an inspection revealed water damage on all three floors. The cause of the damage was traced to the hotel attic where a hot water recirculation line had separated.

Omkar contends Sun Coast or one of the sub-subcontractors failed to properly attach the pipe, which allowed hot water to flood the property for several hours. The hotel owners say the water, steam and moisture exposure forced them to completely replace the contents of 58 rooms.

Marriott refused to allow the Springhill Suites Seabrook to open until the guest rooms and public spaces were repaired and restored. Omkar says the hotel was forced to remain closed until Oct. 8 when it opened 50 rooms. The company says another 20 rooms were able to be rented to guests beginning Nov. 19. The cost of the repairs is listed at $3.1 million.

Omkar says Sun Coast is guilty of negligence, a breach of implied warranty, fraud and a violation of the Texas Deceptive Trade Practices Act. The hotel owners say the plumbing company caused them to lose income and to be stigmatized.

Omkar is asking to be awarded actual, treble and exemplary damages along with interest, court costs and attorney fees.
